.... a very long piece tomorrow on the outrageous decision in Californicated this evening in which a jury acquitted an illegal invader of all charges, save one, in shooting Kate Steinle.

The jury "bought" the defense argument that the charge was "racist."

But I'm not going to put in the effort because nobody in this nation gives a ****.  The Steinle family will not obtain justice and that's your responsibility, America.

No, I don't think that illegal invader should have been convicted of murder.  Murder requires intent.  I don't know if that was proved; I wasn't on the jury.

But manslaughter was a lesser included charge and does not require intent -- just recklessness.

That shooting was without question reckless.

Second, as an illegal invader it was a federal offense for him to possess a firearm.  He was also a convicted felon, so there's a state and federal crime there too.  Rather than imprison him for possession of a firearm by a felon (state charge, on which he was convicted) or try him on the federal charge of acquiring said weapon (a separate and distinct offense)which the Federal Government could do now (it doesn't matter how you acquire said firearm if you're a prohibited person) they're going to deport him instead.

May I remind you that they deported him before and he came back.  What makes you think he won't do it again?  Why deport him rather than imprison him?

So rather than tell you how I really feel about this, I'm simply going to leave you with these two thoughts:

First, **** you Mr. President, as you have no respect for the Rule of Law or your Just-Us department would try that illegal invader for the federal offense of illegally obtaining a firearm as an illegal invader in federal court and upon conviction toss his ass in federal prison for doing so, or let the state sentence and imprison him on the STATE charge he was convicted of first (possession of a firearm by a felon), try him on the federal charge and then deport him when he has served said sentences.  I remind you that DoucheNozzle Trump has repeatedly criticized Obama for being "soft on federal gun crimes" (such as acquiring guns as a felon); so much for Trump having a sack when it comes to enforcing the law.

You, Mr. President, just destroyed the last bit of respect I had for you.  May you burn in eternal Hell along with Kate's killer; you deserve to join him for your complicity in not trying this jackass in federal court.  I remind you that the Executive is charged with enforcing the law and the President's Oath of Office requires that he do so faithfully.

And second, **** you California.  I respect the decision of the jury but it damn well ought to have consequences, all lawful and enforced by the people of this country.  It won't because we no longer have anyone left in this nation with a sack, but if you think I'll be sorry or enraged and willing to fight if the Norks nuke San Francisco tomorrow morning..... you're wrong.

Yep. The guy had something to do with discharging a firearm, and there was such-and-such about deflections and stuff. He, as a felon, should have never have had that firearm or its ammunition in his presence. Right, so far?

Young person, Kate Steinle, was hit by a projectile from that firearm, after deflection from a pier or some such thing. Then shards from that projectile (or another) did strike her upon the back and result in her death.

That's the story.

Another, and a very compelling part of the story, is that the shooter had no right to possess a firearm above the grade of a BB-gun. In fact, he had no right to be in this country whatsoever, possessing anything in this country.

So, now the Great State of California have released him from all charges, and his only punishment will be deportation. How many times has this SOB been deported and has still returned several times?

Oh, I certainly hope the lawsuits will soon, or eventually, drain the "Great Bear Republic's" coffers of everything. Not that I expect it, but I know how it's going to work out.

ricochet or not (and a pistol round ricochetting and killing someone is a very rare and improbable occurrence) if i was the father or brother of this girl, there would be a dead mexican now. and not because of a ricochet.

If A CC permit holder had an errant bullet kill an innocent bystander in CA, it would have been a murder conviction.

Really makes me think twice about ever getting involved unless my family or myself are directly threatened.

Sorry, but I'm afraid to go read news about it. I got my monthly quota of that yesterday when my autistic stepson freaked out because the internet was going to be shut down on dec 14th when net neutrality gets canned. He read the "news" about the vote and when I started skimming articles, I understood how he came to that conclusion.

To what extent was that jury vote influenced by jurors fearful that a "guilty" vote could result in personal retribution from members of the defendant's "community?"

To get nailed for shoplifting as a "third strike" what you steal has to be at the felony level (~$500 I believe) *AND* you must have two prior FELONY convictions.

So you're not exactly "just stealing some groceries" here.....

Firstly, thanks to Karl for documenting the outrageous miscarriage (s) of justice that go on daily. History repeats or "rhymes", and once again the trend of the prevailing world empire is a trend filled with corruption, incompetency, fraud, waste, abuse, grossly perverted acts, hypocrisy and lies, lies, lies and more lies. And let's not forget racism. I predict white people will be demonized and then become the subjects of violence by racist blacks, browns, reds and yellows.

Yeah, the white man is in for a double dose of racism... Big time. And it doesn't matter that the white race has done more for mankind than any other...

So, if you're white and have white children and grandchildren, you best better warn them what's ahead...

As far as guys like Karl go, I'm so glad they are speaking thier mind now while they still can. Read while you can, because guys like Karl will go silent either because they're fed up with trying to educate the ignorant masses or the ignorant masses shut them up...

If he was a felon and had been convicted and served prison time then the USA had ALREADY established jurisdiction over his illegal acts in the country to start.

Sorry but I have no respect for this jury of 'social justice' warriors and they deserve to be dragged out in the street and beaten and then HUNG with the judges, lawyers, and state and federal officials that have perverted justice this day through their actions or inactions.

Time to end ALL Federal aid to California..... start with that President P. Trump Barnum. Oh wait ... he might lose electoral votes next election. Corruption in the highest places is all this is.

Well if this is what influences the behavior of the jury then does it need to be countered balanced from the other side by bringing some rope to the argument too? They then have NOTHING to gain by rendering a decision but someone is going to be pissed. For the record - I am simply pointing how backwards California actually is when the threat of violence determines decision making. Where's the real justice system? As Karl has pointed out - Americans - specifically Californians allowed this.

I am sick of ****ing cowards on these juries that REFUSE to uphold the law or are too stupid to throw out a law because it violates the Constitution. I am sure most jurors in California couldn't get through a basic civics class. Justice is being rendered by the most stupid and the most ignorant of our laws.

The fact that any group could influence the decision of a juror means that the JUROR should not have been on that jury to start. Secondly it only shows what a **** filled state California actually is when the threat of potential mobs - aided by the media - can be used to pervert justice.

While we are at it ... time to prosecute these media people too for inciting violence. It is time to stop letting 'reporting' serve as a means of subversion of justice. The OJ/DEnny thing was made worse by the talking heads spewing crap every night during the trial. The jury made have been blind to what was being said but the public - where the mobs form- were not. This was intentional IMO.

This of course only influences the behavior of future juries as you have pointed out.

How long before justice is rendered solely based on ethnic origin? Not much different than justice based on religious belief as Sharia law is it?

the feds can easily pile on the charges, I would think they could go back and stack on a charge of rentry for each time after the first that he was deported, and those are 20 years each.

Hell he claimed he was shooting at seals at one point, charge him with violating the marine mammal protection act... a jury in California would convict on that one.

oh god this whole case is worse then I had read....

apparently the guy was released to state custody after a federal prison sentence for a local warrant... and they dumped him back on the street after that warrant was cleared rather then giving him back to the feds to deport.

per usa today "Zarate most recently served five years in a federal prison in Victorville, Calif. When he was released, ICE sent him to San Francisco on March 26, 2015, for a 1995 warrant accusing him of selling $20 worth of marijuana.
ICE also requested an immigration detainer sothe agency would be notifiedif he was released."

A key takeaway from this sad story is that juries can no longer be relied upon in deep blue areas. As in this incident, they might refuse to convict someone who is obviously guilty. The flip-side of this is that they might also refuse to acquit someone who is obviously innocent, such as someone who was clearly acting in self-defense.

Note that asking for a bench trial doesn't necessarily help with the latter case, because you could get an activist judge who does the same thing.

This is more of a game-changer than is immediately obvious.

For example, in areas with a SJW infestation, you can't count on an SJW being convicted for physically attacking you for no valid reason. (That's if they're even prosecuted; we've already seen cities like Berkeley and Chicago look the other way when leftists physically attacked rightists.) At the same time, if you have to use physical force to defend yourself against a violent SJW, you might be convicted even though the force was justifiable.

It's yet another reason to stay out of deep blue areas if at all possible.
