An Open Letter To The Okaloosa County Commission

Would you consider it perfectly ok if Mack Busbee, the Okaloosa Property Appraiser, owned a title company and thus made money on real estate transactions in the county while responsible for setting their valuations?

Think about that while reading the following.

Okaloosa County's Commission just voted to raise its millage by 11% next year.  For having the temerity to speak against such an increase I was personally attacked by Commissioner Boyles who read into the record the details of my property ownership, implying that I was a "fat cat" who should not complain.

Yes, Mr. Boyles, I can afford it.  I can also attend a 5:01 PM meeting 30 miles from where working people and our military had just gotten off work 1 minute prior -- and thus couldn't protest personally.

A bit of investigation leads me to believe there may be more motivating Commissioner Boyles than being called out by a voter for promoting a tax increase -- and a 47% budget increase over the last five years.

Commissioner Boyles owns a title company and personally profits from increased real estate churn.  Ad-valorem tax increases hurt renters more than homeowners as rental property does not enjoy either homeowner's exemption or valuation escalator caps.

Millage and valuation increases thus fall disproportionately on service industry employees who earn lower average wages and our military who are subject to involuntary reassignment on a rolling 2-year basis, a fact that makes buying real estate risky for them but very profitable for title companies.

That would be bad enough as an indirect conflict of interest.  But it gets worse because Commissioner Boyles is also listed as the County Commission's liason to the Appraiser's Office and Valuation Adjustment Board.

The property appraiser sets values of the real estate in the county, while the Valuation Adjustment Board is who you appeal to if you think the appraiser screwed you.

So Commissioner Boyles, who owns a title company in Crestview not only has influence over setting the millage (rate of tax charged) he also has influence over both determining value against which that rate of tax is charged and, arguably worse, adjudicating disputes should you have the temerity to argue you were unfairly appraised!

That's not a "thumb on the scale" of justice it's both thumbs and a big toe.

Florida Statutes say the following:

(5) It is hereby declared to be the policy of the state that no officer or employee of a state agency or of a county, city, or other political subdivision of the state, and no member of the Legislature or legislative employee, shall have any interest, financial or otherwise, direct or indirect; engage in any business transaction or professional activity; or incur any obligation of any nature which is in substantial conflict with the proper discharge of his or her duties in the public interest.

Please remember that beyond legal requirements in the Florida Statutes there is an overarching issue: The key principle of sound government ethics policy is that government employees and officials must refrain at all times from even the appearance of impropriety.

Irrespective of whether the letter of law was shaved or flagrantly broken in my opinion Mr. Boyles' participation in the setting of millage and real estate value assessment smells like week-old dead fish.  That Commissioner Boyles is also involved in the dispute resolution process should people believe they got screwed adds crawling maggots all over said week-old dead fish.

Absent Mr. Boyles' "Yea" vote, since the commission passed the millage increase 3-2, the motion to jack the millage up by 11% on all Okaloosa County residents would have failed. The Commission still has a final vote on said millage coming up and can choose to reject it at that time.

Given all of the above the Commission must void said vote, void all contaminated actions taken since Mr. Boyle's ascension to office and act decisively to bar future conflicts.

But whether the Commission acts or not effective means of redress remain with the voters of this county aimed not just at Mr. Boyles but at the entire Commission in the next election and, one hopes, via investigation by the State Attorney General's office.

Property ownership is public record so Poopstain Boyle was within his right to publicly declare what property you own.

However one of the lessons my grandmother taught me early on was never publicly ask someone a question you do not know how they are going to answer.

So I laugh in Poopstain Boyles face, for being stupid enuff to try and browbeat ANYONE publicly. Instead of giving you a logical explanation on the merits of an 11% increase and letting you and other property owners decide, he takes the childish way out.

I commend you for not only sticking to your principles (I wish more people would) but also for taking the time to point out what is going on.

Boyle presented a public question and he did not like your answer and tried to smear you and in so doing stepped in a bigO pile of poo, now he is tracking it around, He wants to increase his bottom line at the expense of the community.

To answer you question directly - No the owner of a company should NOT be able to set the price, that should be the markets job. If you have more people buying a limited supply the price goes up and of course the reverse is true in the other direction.

Why the rest of Okasoola County is not upset is a curiosity, but only a mild one as this type of theft occurs daily and people take it.

People like Poopstain Boyle will continue to smear poop all over until the whole place is covered with it and stinks and THAN people will be like, "Why does is smell like poo?"

Well, yes -- what he did was legal in reading my property records into the public meeting's open record.

But it was both sleazy as hell and designed to intimidate. It was also a mistake, because by doing so he not only failed to intimidate me he guaranteed that I'd do more than 30 seconds of investigation into exactly why he felt threatened enough to do that.

No. They're voted on by the commission. Which "conveniently" stuck the hearing in Crestview at 5:01 PM on a weekday, which is where a huge number of military live but WAY away from where they work, making it impossible for them to get there to protest.

The real problem is of course SPENDING. It always is.

The other way they get you is in the revals. Guy here in Ohio ... his property was recently reval'd along with everyone elses (every 3 years) ... property valuation went up 87% (not a typo). No additions, no improvements, just went up 87%. Needless to say, he has contacted an attorney and he will be fighting it. The problems is, the schools have to approve any appleal to the reval, and of course, there is no incentive for them to do so.

The solution I've come up with is this. I guess this assumes the violence of property tax isn't going anywhere.

Whatever your property is appraised at, you have the right to exercise an option to force the government to buy and flip the property at 10% below appraisal value. If we had an honest system the government should love a program like that, although I suspect you'd simply force a pricing discovery.

That doesn't work here if you are a homeowner; State Statutes limit appraised value increases for homeowners to 3% annually. Was passed decades ago after they started doing exactly THIS to people in SE Florida, forcing 80 year old retirees out by jacking their taxes by 100% a year when the teardowns started in their neighborhood.

Can't do it any more -- EXCEPT to non-owner-occupied (no homeowner's exemption.) Thus, they DO do it -- to rental properties. And this ****s straight up the ass the people who can't afford it, and forces them (most-particularly military) into buying.

Well, since they PCS every 2 years BUYING is ****ing brain-dead stupid for most people as the transaction costs likely exceed the capital gains.

But it's VERY profitable to force military people to do that if you run a ****ing title company, isn't it?

Why hasn't anyone caught this earlier?

I can answer that ... because generally, people do not pay attention. As long as the trash is picked up, the leaves are collected in the fall, the roads are cleared of snow ... they just go to work, pay their taxes and accept it. Most don't have the time nor knowledge which you have to take them on. Plus, you don't have any kids in the school system so they can't hurt you through him/her.

Sleazy is an understatement.

As I read your post first thing this morning the thoughts came to mind;

(A few years back a county in WA state had their search set up where you could type in a persons name and every property that had their name on the title came up. It has since been amended to the address or parcel number.)

Why did Poostain Boyle have your property records and how much effort did he put into obtaining them?

How did he know you were going to oppose him? Did he pull them up during the meeting or has he been sitting on them awhile? How many other people has he tried AND succeed in intimating this way?

Is he stalking you? What other personal information of yours does he have? Is pretending to be a man the only way Poopstain can get a boner?

Seriously, why would he have your personal information handy? If he collected it after you opposed him and then told people that is pretty vindictive.

How did he obtain the information (I know how) did he do it on county property, in county property on county time, using county employees?

It is one piece of **** person, in one small corner of our great country, but I sincerely say THANK YOU!!!


A couple years ago I battled an unjustified officer and the charges were 100% dropped and you helped support my efforts. And for that I am grateful.

I encourage anyone and everyone going through similar intimidation tactics to push back. Bullies only like to bully when they do not get hit back.

F**king love it... not the graft and corruption, but your slapping the sum bitch around.

Guys like Boyles are the poster boys for what is wrong, and always HAS gone wrong in this country... and your set-up and response about you CAN be there, although the folks who just got off work 1 minute ago can't, explains how this kind of racketeering and influence peddling can go on.

Wish it was an isolated case. It's not. Cozy "arrangements" like this go on ALL over the country in many different municipalities.

I really am curious as to when he had Karl's information and who elses he is sitting on.

The only lawful outcome to state and local officials that continue to put money in their friends pockets, or launder money themselves, or have conflicts of interest is to LOCK THEM UP. Since it is blatantly obvious that no one has the balls to lock these people up the next best solution is municipal bankruptcy.

No longer is it a question of IF municipalities will bankrupt themselves, the only question is WHEN and HOW CATASTROPIC it will be. The federal reserve indirectly keeps them afloat which their indiscriminate quantitative easing and low interest rates.

Once that money runs dry so will property tax revenue.

I cannot run for his seat since I don't live in his district. I can do my damndest to see him defeated though by working for and with anyone who opposes him, and I will.

As to when he looked it up, since he had no idea I was going to show up (or obviously who I was or he would have done some research in advance) he had a laptop behind the desk and he did so while I was speaking in opposition to the tax increase, then used his "closing argument" time, in part, to try to intimidate me.

Not only didn't it work after the vote was taken the Chair asked if anyone had any further comments. My hand went up again, I again came up to the lectern and ripped him a new one on the substantive point of the time: He and the other Commissioners put the meeting at an inconvenient time and place on purpose, working people couldn't make it, and while I certainly could afford the tax increase I could also afford to come speak on behalf of those who they intentionally shut out.

Unfortunately I had not expected a tactic like this or I would have researched potential conflicts on ALL the commissioners before the meeting, and REALLY nailed him on the record.

In older days, when there was still rule of law, our State attorney general would have this guy's balls on a plate, sliced into nice, thin strips, and his open wounds would be marinated in Dave's Insanity hot sauce. His career would be destroyed, his financial condition severely damaged, and he'd see some gray-bar hotel time.

Now, it's a shrug from his cronies, probably not a reprimand, because they're probably all employing their useless eater family members in local government.

One day probably soon, this ****'s going to change at a ballistic pace.

While you may not be able to run for "Poopstain" Boyle's seat, If you won in your own district, I can only imagine what his reaction would be to have to serve on the same commission with you.

He would be leaving more than a "stain" when he heard that news!

Mr. Denninger's post on the drive back from the total eclipse was a true public service to the situationally unaware. Why can't our politicians serve the people like that?

I certainly do not want to state what is obvious, but some people may not realize, all property transfers are recorded in the county they took place and are open to the public.

With that being said, if poopstain boyle searched out your public records and used them for political gain, that is to say the least reprehensible, but could it also be illegal use of the information?

Granted I have used the property records on numerous occasions, but never for political gain. If Poopstain did not know you were coming and only checked on your records after you spoke, he used county resources for his political agenda, as a seated politician does he have the legal right to do that?

I do not remember the exact reason why the county in WA State went away from checking property ownership by a persons name, to address and or parcell number, but part of me believes it was because there was too great of room for abuse, when you can check someones name and see how much property they do or do not have - I know there where several names I checked under that system.

A possible solution to this (others may have better knowledge and can give their input), but if you have a LLC or similar you can quite claim your property to it.

Whether someone can afford a tax increase is not the issue, it should be voted open in the light of day where those impacted (Regardless of degree) have the right to give their views WITHOUT being harassed.

It is your property, your money, your time and should not be used in an attempt to shame or browbeat someone into a political action
