Well, if it matters much, I sat all of the animals (cats, dogs, chickens, rabbits, and Coco the pregnant pygmy goat) down today and told them that we needed to lower our carbon footprint to avoid being fined. Asked if anyone had any suggestions. (The mice weren't in attendance.)

After a period of silence, I told them that they can breathe in, but they can't breathe out. They looked at me like I was crazy. I wonder why. :-)

Apparently, the Obama campaign is attempting to thwart a multitude of Democrat primaries.

Michigan Democratic Party Chair Mark Brewer claimed Thursday the Republican Secretary of State Ruth Johnson is engaging in “partisan mischief” by placing President Obama on the state’s Feb. 28 primary ballot.

“It’s caused confusion out there,” Brewer said at a press conference. “It’s completely unnecessary. She knew, she had been repeatedly told that democrats are not participating in this process, but nonetheless, she put Barack Obama’s name on the ballot.”

Why do the dems not want Obama on that ballot? They plan to hold their own caucuses May 5, and, under party rules, voters can’t participate in both a primary and a caucus.

“This has caused enormous confusion and concern among democratic voters throughout Michigan,” Brewer said.

Sec. Johnson wasn’t available Thursday for comment, but her spokesman calls this a non-issue. Those at the Michigan Republican Party agree.

“I think that Mark Brewer is just misinformed,” said communications director Matt Frendewey. “If he were to have his way, it would be a closed, smoke-filled room that would make the choice for who would be the next leader of the free world.”

Frendewey contended a new statute, passed this fall, basically requires the secretary of state to put any well-known candidate on the ballot.

First of all, this process is not new - it's not being done here in Michigan just because of Obama's questionable eligibility. Secondly, why the hell would the Obama campaign try to stop a normal process?! Whatever you think or don't think about his natural born citizenship, this is just freaking suspicious.

Oh, and there is a national movement to push states into doing this. The idea is to at least force him now to provide the required evidence of his eligibility to be on the ballot. http://obamaballotchallenge.com/ And again, there's nothing unusual about the process. Up until 2008, it was just boilerplate proforma procedure for anyone wanting to appear on the ballot for POTUS.

Kyla - Taitz supoenaed Fuddy months and months ago - but Fuddy at first ignored it. Then when a date was scheduled for Taitz to inspect the supoenaed documents (with Court bailiff in tow), Fuddy didn't show. I think there was a Show Cause as well and now apparently, the Judge is at the end of his rope. I do believe there are now multiple legitimate subpoenas requiring Fuddy to present the original long-form BC.

I would assume the next thing would be a default judgment which means he's off the ballot. He would then have to appeal.

Does a motion to compel have to be granted before failure to appear results in contempt, or would ignoring the ruling denying the motion to quash carry the same penalty?

As Karl has said before "the courts move slowly at times BUT they do move"...

Tally: The judge CAN hold someone in contempt from the bench. They rarely do without a show-cause hearing, but they can.

But in this case it doesn't matter. If you intentionally fail to produce the other side can immediately turn around and file a motion for a summary judgment and often will get it.

I suspect that's exactly what Obama and his counsel is expecting and they intend to absorb that and then try to get a stay and cert on appeal. It's a dangerous strategy because if the appeals court follows the law, and they're more likely to than a trial court, they can only review what actually happened in the lower court -- that is, you can't re-try the case.

So in this case his claim on appeal would rest on reversible error in the judgment (e.g. that he doesn't have to prove eligibility.) I don't like those odds and wouldn't take that dice roll myself -- unless I knew that if I produced the documents something exclusionary was in there (e.g. a claim of foreign student aid while in college.)

BTW DO NOT go to Orly's web site. My virus scanner pops a warning on it. I don't know if she's aware of it or not, but I wouldn't be browsing there...
