Kudos to Judge Blackmon!

Carroll County Georgia - Home of the Real Linda Green. Local Atlanta news ran a story today stating that new foreclosure filings were again on the rise in Georgia. It would nice to see other Judges following the rule of LAW and throwing out as many tainted proceedings as they possibly can.

Now if only the remaining 47 states AG's would remove the Bankster c**ks from their respective orifices long enough to read some of the rulings from these seemingly un-corrupted Judges perhaps they would start upholding the LAW and begin prosecuting the Banksters.

Is this a real document? It seems very..."non-courty" in terms of its language and plain spokenness.

I mean, it doesn't cite prior case law (with all manner of gobbledygook abbreviations) and it kind of just says "enough is enough".

Which we may all agree with, but I still think the language, the prose, is very colloquial, not "judicial".

Can someone enlighten me here?

I think that the judge was saying that US bank had taken the HAMP money fraudulently, and wasnt passing it through to the mortgagee's.

What did the person bringing the motion get out of this? Will they get compensation, the right to have their mortgage amended, or clear title on their property? Is he asking someone to prosecute US bank for taking money under false pretences?

Great judgement, but it doesnt make it clear to me what has actually been done here other than to throw out a motion to dismiss?

Carroll County does not appear to have online records, unfortunately, but the case number is in the correct format and it appears that is a real Judge in that county; I found his (old) campaign page (Judges are elected in Georgia)

The Judge points out that 'no administrative review is provided within HAMP, the courts are the only recourse.'

That's all there is. The Judge has staked out his territory with a heavy foot, er mallet. He and other Judges own it. To keep the Judges out of this territory would require an act of Congress I'd wager.

Courts move much slower than criminals unfortunately and most of them have already made a pretty good getaway. Paulson saw this coming of course, that's why he exempted himself from prosecution when he got these bailouts rolling. He had a pretty good idea that a good part of the money would end up in criminal pockets.
