ALERT: Casus Belli - Ex-Post-Facto Law!
 

Now from The Garfield Continuum comes the following warning:

After years of negative judicial decisions about the use of a straw-man on mortgages, MERS was about to lose its existence as well as its credibility. But now all of that is set to change as Wall Street money is pouring into the coffers of those who are receptive (i.e., almost everyone in Congress). The legislation is already being drafted under the interstate commerce clause to ratify MERS and everything it did retroactively. It appears that the Obama administration is ready to pardon all the securitization deviants by signing this bill into law. This information is corroborated by several people who are in sensitive positions — persons who would be the first to know such proposals.

Fortunately, there are some people in Washington who have a conscience and do not want to see this happen.

Besides the obvious seediness of this maneuver, it runs roughshod over state property laws, and the rights of investors, homeowners and borrowers. It amounts to a permanent installation of a Federal system that supersedes the county records for recording property rights. Off-record comments I’ve heard from people in power are outraged at this assault on states’ rights. But these people are not legislators, who are getting promises larger than anything in your imagination, if they will support such a bill. It might be couched as a uniform law to be adopted by the states to get around the states rights issues, but it will permanently remove some of the power over property that lies solely within the jurisdiction of the states and place it preemptively within federal jurisdiction.

All of this is scheduled to happen during the lame duck session of congress between now and the end of the this year, 2010. That means in a manner of days, some bill that may look like it has nothing to do with property, mortgages or foreclosures is going to have attached to it a provision whose effect will go even further than the notarization bill that went through Congress like S–t through a goose and almost got signed by the President. We caught that one AFTER it was passed by Congress unanimously but before Obama signed it.

We announced it as an attempt at a presidential pardon to all those who committed crimes in the notarization of documents that were fabricated and forged, all those who committed forgery and perjury and all those who created counterfeit documentation that was presented to courts as original documents.

This time we got the information, we think, before it was stitched into some innocuous looking bill.  If we don’t find it and block it, the plight of homeowners will get that much worse.

That would be an ex-post-facto law, and is explicitly barred by The Constitution.

Such a bill, were it to be promulgated, would be an act of intentional subversion of The Constitution and a violation of the oath of office of every Congressperson who votes or argues for it.

If such a law is in fact introduced it would turn the rule of law on its ear and make clear that we now live in a nation where literal theft will be made legal retroactively by the Congress and President in an explicit form and with the impact of literally stealing millions of privately-held homes.

Do not underestimate the desire of the federal government to further its power at the expense of states' rights. As opposed to that Russian who was talking about the US breaking up into smaller territories, I believe we will see an attempt to eliminate states in the sense that they will only be lines on a map. All governing decisions will come from DC.

Once the Feds have their foot in the door to control the title to real estate you can bet Federal property taxes will follow. They never do anything for free nor do they do it cheaply and efficiently. Nobody will be secure in their home with a distant and indifferent avaricious power with so many needy friends defining your ownership.

Calder vs Bull 3 U.S. 386 (1798) is still binding precedent in the area of ex-post facto laws. (See, Article I, Section 9-10 US Constitution) It forbids an act of Congress (and the states) which criminalizes or INCREASES a criminal penalty or in civil cases changes the relationship between contracting parties retroactively. It does not apply to decriminalizing a particular act -- such as amnesty acts.

If this law is a pardon to all "prior bad acts" then it probably passes muster. If it is attempt to retroactively change contractual and property law regarding mortgages and state recording laws to make MERS legal it ain't gonna fly.

As I understand it ex post facto is only considered within our constitution to mean making things illegal in the past which were legal at the time. Supposedly it is fine to make things legal in the past which were illegal at the time. I am not a lawyer. Just from my personal research into the law enabling warrantless wiretapping for the government by the telcos.

I very much support ex post facto meaning exactly what it says not as it is currently interpreted.

When was the last time government in any capacity gave a damn about the US Constitution? Arizona's immigration laws accordingly should have been heard 1st at the US Supreme Court, as every Attorney's General challenge of Healthcare. Obama/Bush rendition/torture programs are a violation of UN Declaration of Human Rights Charter to which we are a signature. The obama assassination program deprives the accused of life without due process. There are wire-tapping violation (4th Amendment) by the big telecom that were granted retroactive immunity from prosecution. The police now have the ability to tag and track vehicles without a warrant. The FBI crashed into the homes of peace protesters just a few months back, without cause, found the infamous nothing burger, and issued grand jury supenas that were ignored, and then rescinded them to save face. What was the last time a traffic ticket exceeding $20 was allowed to be heard before a jury?

Why are you upset when the government violates the Constitution? Why do you find it surprising or outrageous? Everyone knows that the government is as legitimate as a $3 bill. Everyone knows that the government breaks the law more than the MAFIA ever did. Everyone knows the government is corrupt to the core.

Why don't we tailor the message to be have we had enough yet, and what are we going to do about it? Oh, I know lets vote in some corrupt people who like tea. No, red people. No, blue people. No, independents. No, no constitutionalists. No,...

Can we finally admit that the system is broke. That there are no checks and balances. That the people have no legal recourse. That it was rigged, is rigged, and will ALWAYS be rigged no matter who holds the reigns of power?

Bankers should just hire death squads to kill and seize property as they wish.

I always wondered about this in regards to retro-active tax laws as well. Pretty sure it's only an issue when a punishment is enacted or increased.

WTF is the government going to do here? Dissolve itself? Hit itself on the nose with a newspaper and say "Bad Dog!"?

Great, we end up without a President, Congress, Judiciary, etc.

Why the hell not just pick up your favorite instrument of chaos (rifle, plane, etc.), and just go wreck shop?
